Pregnancy-Related Expenses
Living Infants Fairness and Equality (LIFE) Act
The LIFE Act amended Georgia law, Official Code of Georgia (O.C.G.A.) § 19-6-15, to allow an expectant mother to seek reimbursement for direct medical and pregnancy-related expenses from her child’s father.
Eligibility
Expectant mothers and mothers who gave birth after July 20, 2022, who have maintained documentation of pregnancy-related expenses are eligible to receive reimbursement. To obtain the documents needed to initiate an action, see the related files listed below.
Important Notice
As a result of federal law and the federal IV-D program funding rules, the Division of Child Support Services (DCSS) and all DCSS employees or agents are prohibited from assisting any mother with the recoupment and collection of prenatal expenses because such costs are not recognized under the federal IV-D program funding rules.
Until there is a change in federal law and/or IV-D rules, DCSS offices and all DCSS employees or agents are unable to provide any services directed at the collection or enforcement of any court order related to any pre-birth direct medical and pregnancy-related expenses of the mother as part of any child support recovery action.
Mothers in need of legal assistance regarding the collection or enforcement of any court order related to any pre-birth direct medical and pregnancy-related expenses are encouraged to seek legal assistance from Atlanta Legal Aid or the Georgia Legal Services Program if they reside outside of metro Atlanta.
